These Terms and Conditions ("Terms") are an agreement between you and Trybestack Ltd (RC 9286253), the company that runs SaidCard at saidcard.com ("SaidCard", "we", "us"). By using SaidCard you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use SaidCard.
If you use SaidCard for a company or other organisation, you confirm you can accept these Terms for it, and "you" includes that organisation.
What SaidCard is
SaidCard is an online tool for designing quote cards in the style of social media posts, and exporting them as images. It includes a studio, templates, optional accounts that save your settings, and a feature that reads public post links. Most of the work happens in your browser. SaidCard is free today. We may add paid features later; if we do, we will show the price and any extra terms before you pay, and nothing you use for free today will start costing money without your agreement.
Who can use SaidCard
You must be at least 13 years old, or the minimum age for digital consent where you live if that is higher, to create an account. If you are under 18, you confirm a parent or guardian has agreed to these Terms for you.
Your account
You can sign in with Google or with a one time code sent to your email. Keep access to your email and Google account secure, because anyone with access to them can sign in to your SaidCard account. You are responsible for activity under your account. Tell us at once if you think someone else has used it. You can delete your account at any time on your account page.
Your content
"Your content" means the text, names, handles, photos, fonts and other material you add to SaidCard, and the cards you create. You keep all the rights you have in your content. We do not claim ownership of it.
So that we can run the service, you give us a worldwide, non exclusive, royalty free licence to store, process and display your content only as needed to provide SaidCard to you (for example, saving your settings to your account and showing them on your other devices). This licence ends when you delete the content or your account, except for copies in routine backups, which are overwritten within 30 days.
You confirm that you have the rights you need in your content, including photos of other people and any font files you load, and that using it with SaidCard does not break the law or anyone else's rights.
Acceptable use
Quote cards look like real posts, so they must be used honestly. You agree not to use SaidCard to:
Make a card that puts words in a real person's or organisation's mouth that they did not say or write, or present a made up post as genuine.
Impersonate anyone, or mislead people about who made a statement, including by using someone else's name, photo, handle or verified badge to deceive.
Defame, harass, threaten, bully or abuse anyone, or encourage violence or hatred against people based on who they are.
Create or share sexual content involving minors, sexual content without consent, or content that exploits anyone.
Spread content intended to deceive voters, defraud people or manipulate markets, or that is otherwise unlawful.
Infringe copyright, trademarks or other rights, including by using fonts, photos or posts you do not have the right to use.
Interfere with SaidCard, get around rate limits or security, scrape it at scale, or use it to send spam.
Satire and parody are welcome when a reasonable viewer can tell they are satire or parody. If you are unsure, add a clear label.
Post links and other people's posts
The post link feature reads a single public post you point it to and shows its author, text and public counts. That content belongs to its author and the platform it was posted on. When you use it, you are responsible for making sure you may share the post in the way you intend, for example as commentary, criticism, news or with permission. SaidCard keeps the imported words exactly as written; do not alter them and present the result as the original post. Remove a card if the author asks you to and you have no right to keep it.
We may change or stop post link support for any platform at any time, for example if a platform changes how it shares public posts.
Trademarks of other platforms
X, Twitter, Facebook, Instagram, Threads, LinkedIn and TikTok are trademarks of their owners. SaidCard is not affiliated with, endorsed by or sponsored by any of them, or by any creator named on our site. Templates are designed to look familiar so your card fits the feed, and are not official materials of those platforms. Follow each platform's own rules when you post your cards there.
Our rights
SaidCard's software, design, templates, text, logo and the SaidCard name belong to us or our licensors and are protected by law. These Terms give you a personal, limited, non exclusive, non transferable right to use SaidCard as offered. You may use, post and sell the cards you create, including for commercial purposes, as long as you follow these Terms. You may not copy, resell or rebuild SaidCard itself, or use our name or logo in a way that suggests we endorse you, without our written permission.
Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
Third party services
SaidCard relies on services from other companies, including Cloudflare and Google. Your use of Sign in with Google is also subject to Google's terms. We are not responsible for third party services, and links to other websites are provided for convenience only.
Changes and availability
We are always improving SaidCard, so features may change, be added or be removed. We try to keep SaidCard available, but we do not promise it will always be available, uninterrupted or error free. We may limit use to protect the service.
Suspension and termination
You can stop using SaidCard and delete your account at any time. We may suspend or close an account, or block access, if you break these Terms, if the law requires it, or to protect SaidCard, our users or others. Where reasonable we will tell you why and give you a chance to respond at hello@saidcard.com. The sections on your content licence end, disclaimers, liability, indemnity and law survive termination.
Disclaimer of warranties
SaidCard is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that SaidCard will meet your needs, that cards will look exactly like a platform's current design, that imported posts or counts are complete or current, or that the service is free of errors. Nothing in these Terms limits rights you have under consumer protection law that cannot be limited. See also our Disclaimer.
Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, reputation or goodwill, arising from your use of SaidCard or the cards you create. Our total liability for all claims about SaidCard is limited to the greater of the amount you paid us in the 12 months before the claim and fifty thousand Nigerian naira (₦50,000). These limits do not apply to liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.
Indemnity
If you break these Terms or the law, or infringe someone's rights through content you create with SaidCard, you agree to cover the reasonable losses and costs (including legal fees) that we suffer as a result, to the extent the law allows.
Law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting any formal claim, please email hello@saidcard.com so we can try to resolve it informally within 30 days. If we cannot, the courts of Nigeria have jurisdiction. If you live outside Nigeria, you keep any protection the law of your country gives you that cannot be removed by agreement.
Changes to these Terms
We may update these Terms as SaidCard changes. We will change the date at the top and, for significant changes, tell signed in users before they take effect. If you keep using SaidCard after changes take effect, you accept the new Terms.
General
If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale. These Terms, together with the Privacy Policy and Disclaimer, are the whole agreement between you and us about SaidCard.
